The U.S. International Trade Commission (USITC) today determined that revoking the existing antidumping duty orders on imports of seamless refined copper pipe and tube from China and Mexico would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.
As a result of the Commission’s affirmative determinations, the existing antidumping duty orders on imports of these products from China and Mexico will remain in place.
Chair Jason E. Kearns, Vice Chair Randolph J. Stayin, and Commissioners David S. Johanson, Rhonda K. Schmidtlein, and Amy A. Karpel voted in the affirmative.
Today’s action comes under the five-year (sunset) review process required by the Uruguay Round Agreements Act. See the attached page for background on these five-year (sunset) reviews.

BACKGROUND
The Uruguay Round Agreements Act requires the Department of Commerce to revoke an antidumping or countervailing duty order, or terminate a suspension agreement, after five years unless the Department of Commerce and the USITC determine that revoking the order or terminating the suspension agreement would be likely to lead to continuation or recurrence of dumping or subsidies (Commerce) and of material injury (USITC) within a reasonably foreseeable time.
The Commission’s institution notice in five-year reviews requests that interested parties file responses with the Commission concerning the likely effects of revoking the order under review as well as other information. Generally within 95 days from institution, the Commission will determine whether the responses it has received reflect an adequate or inadequate level of interest in a full review. If responses to the USITC’s notice of institution are adequate, or if other circumstances warrant a full review, the Commission conducts a full review, which includes a public hearing and issuance of questionnaires.
The Commission generally does not hold a hearing or conduct further investigative activities in expedited reviews. Commissioners base their injury determination in expedited reviews on the facts available, including the Commission’s prior injury and review determinations, responses received to its notice of institution, data collected by staff in connection with the review, and information provided by the Department of Commerce.
The five-year (sunset) reviews concerning Seamless Refined Copper Pipe and Tube from China and Mexico were instituted on November 1, 2021.
On February 4, 2022, the Commission voted to conduct expedited reviews for these investigations. Commissioners Jason E. Kearns, Randolph J. Stayin, David S. Johanson, Rhonda K. Schmidtlein, and Amy A. Karpel concluded that for these investigations, the domestic group response was adequate, and the respondent group response was inadequate.

The United States International Trade Commission (USITC) today determined that a U.S. industry is materially injured by reason of imports of seamless refined copper pipe and tube from Vietnam that the U.S. Department of Commerce (Commerce) has determined are sold in the United States at less than fair value.
Chair Jason E. Kearns, Vice Chair Randolph J. Stayin, and Commissioners David S. Johanson, Rhonda K. Schmidtlein, and Amy A. Karpel voted in the affirmative.
As a result of the Commission’s affirmative determination, Commerce will issue an antidumping duty order on imports of these products from Vietnam.

Product Description: All seamless circular refined copper pipes and tubes, including redraw hollows, greater than or equal to 6 inches (152.4 mm) in actual length and measuring less than 12.130 inches (308.102 mm) in actual outside diameter (OD), regardless of wall thickness, bore (e.g., smooth, enhanced with inner grooves or ridges), manufacturing process (e.g., hot finished, cold-drawn, annealed), outer surface (e.g., plain or enhanced with grooves, ridges, fins, or gills), end finish (e.g., plain end, swaged end, flared end, expanded end, crimped end, threaded), coating (e.g., plastic, paint), insulation, attachments (e.g., plain, capped, plugged, with compression or other fitting), or physical configuration (e.g., straight, coiled, bent, wound on spools). This description includes seamless refined copper pipe and tube produced or comparable to the American Society for Testing and Materials (ASTM) ASTM-B42, ASTM-B68, ASTM-B75, ASTM-B88, ASTM-B88M, ASTM-B188, ASTM-B251, ASTM-B251M, ASTM-B280, ASTM-B302, ASTM-B306, ASTM-B359, ASTM-B743, ASTM-B819, and ASTM-B903 specifications and meeting the physical parameters described therein, but excludes seamless circular hollows of refined copper less than 12 inches in actual length whose actual OD exceeds its actual length.

The United States International Trade Commission (USITC) today determined that a U.S. industry is threatened with material injury by reason of imports of seamless refined copper pipe and tube from China and Mexico that the U.S. Department of Commerce (Commerce) has determined are sold in the United States at less than fair value.
Chairman Deanna Tanner Okun and Commissioners Daniel R. Pearson, Shara L. Aranoff, and Irving A. Williamson made affirmative determinations on the basis of threat. Commissioner Charlotte R. Lane made affirmative determinations on the basis of present injury. Commissioner Dean A. Pinkert did not participate in these investigations.
As a result of the USITC's affirmative threat determinations, Commerce will issue antidumping duty orders on imports of these products from China and Mexico.

Also included are sets of seamless refined copper pipes and tubes, including "line sets" to connect outdoor air conditioners or heat pumps to indoor evaporator units. The products subject to these investigations are currently classifiable under HTS subheadings 7411.10.1030 and 7411.10.1090, and may also enter under HTS subheadings 7407.10.1500, 7419.99.5050, 8415.90.8065, and 8415.90.8085.
