Passenger Vehicle and Light Truck Tires from Korea, Taiwan, and Thailand, and Subsidized Passenger Vehicle and Light Truck Tires from Vietnam, Injure U.S. Industry, Says USITC

The United States International Trade Commission (USITC) today determined that a U.S. industry is materially injured by reason of imports of passenger vehicle and light truck tires from Korea, Taiwan, and Thailand that the U.S. Department of Commerce (Commerce) has determined are sold in the United States at less than fair value and subsidized by the government of Vietnam.

The Commission further found that imports of these products from Vietnam that Commerce has determined are sold in the United States at less than fair value are negligible and voted to terminate the antidumping duty investigation concerning Vietnam.

Chair Jason E. Kearns, Vice Chair Randolph J. Stayin, and Commissioners Rhonda K. Schmidtlein and Amy A. Karpel voted in the affirmative with respect to the antidumping duty investigations involving Korea, Taiwan, and Thailand and the countervailing duty investigation concerning Vietnam.  They made a finding of negligibility with respect to the antidumping duty investigation involving Vietnam. 

Commissioner David S. Johanson voted in the negative with respect to the antidumping duty investigations involving Korea, Taiwan, and Thailand and the countervailing duty investigation concerning Vietnam.  He made a finding of negligibility with respect to the antidumping duty investigation involving Vietnam. 

As a result of the Commission’s affirmative determinations, Commerce will issue antidumping duty orders on imports of these products from Korea, Taiwan, and Thailand, and a countervailing duty order on imports of these products from Vietnam.  As a result of the finding of negligibility, the antidumping duty investigation regarding imports of these products from Vietnam will be terminated.

Product Description:  Passenger vehicle and light truck tires (PVLT tires) are new pneumatic tires of rubber, designed principally for highway use on standard passenger cars, sport utility and crossover vehicles, vans and light trucks. Subject tires are primarily of tubeless steel-belted radial ply design, sold in the 13- to 26-inch rim diameter range to original equipment manufacturers or in replacement markets. PVLT tires, tube or tubeless, radial or non-radial, produced domestically or imported must conform to applicable motor vehicle safety standards of the National Highway Traffic Safety Administration (NHTSA), Department of Transportation (DOT), including the "DOT" symbol on subject tire sidewalls. Excluded from the scope are tires absent the DOT symbol, certain off-the-road, spare, and trailer tires, used or retreaded tires, or non-pneumatic tires such as solid rubber tires, and specifications outside of the Tire and Rim Association Year Book.

USITC Makes Determinations in Five-Year (Sunset) Reviews Concerning Passenger Vehicle and Light Truck Tires from China

The U.S. International Trade Commission (USITC) today determined that revoking the existing antidumping and countervailing duty orders on imports of passenger vehicle and light truck tires from China would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. 

As a result of the Commission’s affirmative determinations, the existing orders on imports of these products from China will remain in place. Chair Jason E. Kearns, Vice Chair Randolph J. Stayin, and Commissioners Rhonda K. Schmidtlein and Amy A. Karpel voted in the affirmative. Commissioner David S. Johanson voted in the negative.

Today’s action comes under the five-year (sunset) review process required by the Uruguay Round Agreements Act.  See the attached page for background on these five-year (sunset) reviews.

BACKGROUND

The Uruguay Round Agreements Act requires the Department of Commerce to revoke an antidumping or countervailing duty order, or terminate a suspension agreement, after five years unless the Department of Commerce and the USITC determine that revoking the order or terminating the suspension agreement would be likely to lead to continuation or recurrence of dumping or subsidies (Commerce) and of material injury (USITC) within a reasonably foreseeable time.

The Commission’s institution notice in five-year reviews requests that interested parties file responses with the Commission concerning the likely effects of revoking the order under review as well as other information.  Generally within 95 days from institution, the Commission will determine whether the responses it has received reflect an adequate or inadequate level of interest in a full review.  If responses to the USITC’s notice of institution are adequate, or if other circumstances warrant a full review, the Commission conducts a full review, which includes a public hearing and issuance of questionnaires.

The Commission generally does not hold a hearing or conduct further investigative activities in expedited reviews.  Commissioners base their injury determination in expedited reviews on the facts available, including the Commission’s prior injury and review determinations, responses received to its notice of institution, data collected by staff in connection with the review, and information provided by the Department of Commerce.

The five-year (sunset) reviews concerning Passenger Vehicle and Light Truck Tires from China were instituted on July 1, 2020.

On October 5, 2020, the Commission voted to conduct an expedited review. Commissioners Rhonda K. Schmidtlein, Jason E. Kearns, Randolph J. Stayin, and Amy A. Karpel concluded that the domestic group response was adequate and the respondent group response was inadequate and voted for expedited reviews.  Commissioner David S. Johanson concluded that the domestic group response was adequate and the respondent group response was inadequate and voted for full reviews.

USITC Votes to Continue Investigations Concerning Passenger Vehicle and Light Truck Tires from Korea, Taiwan, Thailand, and Vietnam

The United States International Trade Commission (USITC) today determined that there is a reasonable indication that a U.S. industry is materially injured by reason of imports of passenger vehicle and light truck tires from Korea, Taiwan, Thailand, and Vietnam that are allegedly sold in the United States at less than fair value and subsidized by the government of Vietnam. 

Chair Jason E. Kearns, Vice Chair Randolph J. Stayin, and Commissioners David S. Johanson, Rhonda K. Schmidtlein, and Amy A. Karpel voted in the affirmative. 

As a result of the Commission’s affirmative determinations, the U.S. Department of Commerce will continue with its antidumping and countervailing duty investigations concerning imports of these products from Korea, Taiwan, Thailand, and Vietnam, with its preliminary countervailing duty determination due on or about August 26, 2020, and its antidumping duty determinations due on or about November 9, 2020.

USITC Votes To Continue Cases on Certain Passenger Vehicle and Light Truck Tires from China

The United States International Trade Commission (USITC) today determined that there is a reasonable indication that a U.S. industry is materially injured or threatened with material injury by reason of imports of certain passenger vehicle and light truck tires from China that are allegedly subsidized and sold in the United States at less than fair value.

Chairman Meredith M. Broadbent, Vice Chairman Dean A. Pinkert, and Commissioners Irving A. Williamson, David S. Johanson, F. Scott Kieff, and Rhonda K. Schmidtlein voted in the affirmative.

As a result of the Commission's affirmative determinations, the U.S. Department of Commerce will continue to conduct its investigations on imports of these products from China, with its preliminary countervailing duty determinations due on or about August 27, 2014, and its antidumping duty determinations due on or about November 10, 2014.

Product Description: New pneumatic passenger vehicle and light truck (PVLT) tires, of rubber, with tire size designations, whether or not mounted to wheels. PVLT tires are designed for use on passenger cars and associated multipurpose vehicles, and light trucks. Subject tires typically range from 13 to 24 inches in rim diameter and may be tubeless or tube-type, radial or non-radial in construction, intended for sale to original equipment manufacturers or the replacement market. PVLT tires must carry the symbol "DOT" on the sidewall, certifying applicable motor vehicle standards. Subject tire sidewalls may or may not be marked with a "P" for passenger cars and associated vehicles, or an "LT" for light trucks; however, all subject product tires must conform to Tire and Rim Association Year Book specifications.
